Pharmaceutical giant Merck has won yet another case after a judge ruled in its favor over claims from a Kentucky man that the drug manufactured by the company, Vioxx, caused his heart attack several years ago. The federal jury found that there was insufficient evidence to link the plaintiffs heart attack to the controversial painkiller, and deliberated for just a few hours before reaching their decision.
The plaintiff, 56-year-old Robert Garry Smith, stated that he suffered a heart attack three and a half years ago, and that his heart attack was the result of taking the cox-2 inhibitor, which is now at the center of thousands of lawsuits that have been filed against Merck.
Merck officials have sworn to fight each case filed against the company on an individual basis, and so far have won many of the cases, including one multi-million dollar award that was later overturned. The company released news of this latest victory shortly after the jury reached its decision.
Vioxx, the painkiller at the center of all the controversy, was withdrawn from the market in 2004 after it came to light that the drug could cause a number of serious side effects, such as heart attacks and strokes.
