Following recent reports that legal officials working for the drug manufacturing giant Merck had requested access to a jurors financial records to ascertain the jurors links to a plaintiff in a Vioxx related court case, a judge has now granted this access to the company.
The plaintiff in the case won over $30 million in damages from Merck, but legal officials from Merck stated that there was a financial link between the plaintiff and the juror, and that the plaintiff had made loans to the juror in the past, linking them financially.
The juror, Jose Manuel Rios, testified that he had borrowed money from the plaintiff, Felicia Garza, on an interest free basis. Garza won damages for the wrongful death of her husband, who she alleged died as a result of taking the cox-2 inhibitor Vioxx, manufactured by Merck.
The judge has now granted access to both financial records and cell phone records of Rios, enabling Merck officials to establish the extent of the link between the juror and the plaintiff.
