The third federal trial against Merck, the manufacturer of the controversial painkiller Vioxx, is now underway in New Orleans. The jury has been selected and seated for the trial, in which a 56-year-old man is suing the pharmaceutical company after suffering a heart attack several years ago, which he claims was a result of taking the cox-2 inhibitor, Vioxx.
The plaintiff, Robert Garry Smith, is said to have started taking the drug after the labelling was strengthened to reflect a heightened risk of heart problems. However, Smith stated that until he actually saw legal advertisements relating to Vioxx litigation, he was not even aware that the drug could have been responsible for the heart attack, which he suffered in 2003.
Smith further claims that until he had his heart attack after being prescribed the drug he was perfectly healthy. Merck added information to the labelling of the drug in relation to heart attacks in 2002. Other cases that have been heard so far in relation to Vioxx have been those of plaintiffs that took the drug prior to the revised labelling.
Thousand of lawsuits have been filed against Merck over the drug, after many people suffered heart attacks and other health problems after taking the medication.
