A New Jersey Superior Court Judge has signed an order that aims to stop employees of the drug manufacturing giant Merck from discussing its controversial painkiller Vioxx over the companys voicemail system. The order was signed late last week by the Superior Court Judge Carol Higbee.
In addition to the ban on employees discussing the drug over the voicemail system, the judge also ordered that any existing messages that were related to the companys withdrawn cox-2 inhibitor drug needed to be securely preserved.
The judge decided to sign the order after a number of attorneys working on behalf of plaintiffs that are suing the drug company asked that such messages be preserved for use as evidence during legal proceedings. An attorney for Merck did respond to the requests, stating that the task would be unduly burdensome.
The order does not include Vioxx related messages and information from legal employees of the drugs company, as much of their discussion will relate to Vioxx related litigation.
