Vioxx Lawsuits Continue To Grow

Just a week after the manufacturer of the controversial painkiller, Vioxx, was defeated in its first court case, reports indicate that the number of suits being filed against Merck has hit nearly 5,000 and is expected to continue to grow. Merck suffered a massive loss when a jury awarded the widow of a deceased Vioxx patient a multi million dollar award. The company planned to appeal against the decision, but in the meantime the number of lawsuits against the company continues to rise.

Around 1,800 cases against the pharmaceutical giant have been filed in federal court alone, and it has been suggested that the numbers could grow to three times this size. Merck is expected to face massive losses as cases against the company continue to go to court. Based on the conclusion of the first case against the pharmaceutical company, Merck could be facing many payouts to Vioxx victims.

Merck has stated that it will fight against the award made to the plaintiff in the first trial. However, lawyers have stated that there is a ‘one in a million’ chance of the company having any success in its bid to argue the award made in the Texas trial.

With regards to the decision to appeal, a Merck lawyer stated: "Our strategy here is to defend the case on the issue of causation. We believe the science will carry the day."
