The manufacturer of controversial painkiller Vioxx, which was removed from the market in 2004 after being found to heighten the risk of heart attacks and strokes, has spoken out about the recent decision of a judge to dismiss damages awarded to a man that suffered a heart attack after taking the painkiller.
The award of over $50 million was made to Gerald Barnett, a former FBI agent, who suffered a heart attack in 2002. However, a federal judge in New Orleans stated that the award was excessive and has dismissed the award and ordered a retrial on both compensation and punitive damages.
A Merck spokesperson stated: "We are pleased the court agreed that the compensatory damages awarded were excessive and bore no relationship to the evidence presented in trial and that the court overturned the punitive damages, as well."
He also added: "Within the next several days we will be filing a motion requesting that the new trial also include all liability issues. Whatever the scope of the new trial, we look forward to presenting our evidence to the new jury."
