Attorneys that work on behalf of the pharmaceutical giant Merck have asked to see the financial records of one of the jurors that was involved in a recent trial relating to the controversial cox-2 inhibitor Vioxx. It is alleged that the man was on the jury of a woman that won over $30 million in damages, and that he had financial ties with the plaintiff.
It has been alleged that Jose Manuel Rios a school janitor served on the jury when Felicia Garza, the widow of a man that died from a heart attack, won the award. It was found that he had borrowed thousands of dollars interest free from the woman, who had allegedly been lending money to other community members too.
Mercks attorneys state that they want the financial records to help them to get to the bottom of the financial relationship between the juror and the plaintiff.
One Merck attorney stated: "Everyone is entitled to a fair trial. A financial relationship with a juror raises a serious question as to whether the Garza trial was consistent with these vital principles."
