Merck Slated By Texas Attorney General

Added September 2nd, 2005

The pharmaceutical giant, Merck, manufacturer of the controversial cox-2 inhibitor Vioxx, has been slated by Texas Attorney General Greg Abbott for trying to claim that the state’s lawsuit misrepresented its drug’s safety and asking for the lawsuit to be taken out of the federal courts.

The Attorney General stated: “Merck may try to run from the Texas courts, but they will not be able to hide from their scheme to misrepresent the safety of Vioxx to Texans. The company is clearly trying to evade justice by using these delay tactics.” He added: “This is a major disappointment to the taxpayers of Texas, who deserve to be reimbursed for the company’s wrongful scheme to defraud Medicaid. I urge Merck to stop evading their obligations. A Texas jury deserves to hear evidence of fraud in a Texas district court.”

In the state’s lawsuit it is alleged that Merck did disclose the dangerous effects of Vioxx to patients, doctors, or pharmacists. It is also alleged that the drug was marketed aggressively, again with no mention made of some of the deadly side effects and dangers, such as increased risk of heart attacks or strokes. Also, Merck is said to have known about these dangers and yet still placed Vioxx on the Medicaid list, where Medicaid paid over $55 million in reimbursements for the painkiller.
