The manufacturer of Vioxx, Merck, has been dealt another blow after a New Jersey judge ruled that health plans that used to pay for Vioxx prescriptions for patients can sue as part of a class action. The judge has ruled this in order to enable the health schemes to recoup some of the money spent on the painkillers, which ran into billions of dollars.
The motion was filed by a labor union health plan, and this union had sued Merck in 2003 because it stated that Merck had deceived them about the effects of Vioxx, and had the truth been known billions of dollars would not have been spent on paying for Vioxx treatment for patients.
Merck has responded by stating that the claims are unfounded. The pharmaceutical giant has already been hit with many lawsuits from individuals that have been affected by the controversial cox-2 inhibitor, Vioxx. However, the ruling that now allows these health plans to sue the manufacturer as well will simply make matters worse for Merck.
