Lawsuit Filed Against Merck By Durham Man

A Durham man that claims to have experienced health problems after taking Vioxx on and off for a number of years is suing Merck & Co, the pharmaceutical giant that manufactures the controversial painkiller. The lawsuit alleges that Merck put thoughts of profit over the welfare and health of those taking the drug, and that the company failed to advise doctors and patients about the real dangers of the drug.

In fact, the lawsuit describes Merck’s actions in failing to provide details of the dangers of the drug as "clear, blatant and outrageous conduct." John Johnson’s lawsuit against Merck is said to be the first like it in the area. Johnson states that he took the drug between 1999 and 2004, when it was taken off the market, and that during these times he suffered a range of health problems.

Merck has already been sued by many people that have suffered personal injury through taking Vioxx, as well as being sued by the families of those that have died from Vioxx related problems. In addition to facing personal injury and wrongful death lawsuits, a judge has also ruled that health care plans can file a class action for billions of dollars spent on paying for Vioxx for patients.
