In the headline trial of Carol Ernst against pharmaceutical giant, Merck, it has been alleged that Merck lied to doctors about the risks associated with its controversial cox-2 inhibitor drug, Vioxx. Ernsts attorney, Mark Lanier, has produced evidence in court to show that Merck did in fact hide the deadly risks of the drug from doctors, and then went on to claim that nobody had died as a direct result of taking Vioxx.
Amidst the controversy over the drug and over how Merck acted, the pharmaceutical company has been accused of glossy, high pressure advertising and sales, withholding information about the drug, and failing to disclose information about deadly side effects even though documentation suggests that Merck officials were aware of these dangers many years ago.
It has also been alleged that Merck used its connections with the Food and Drugs Administration to its advantage, choosing to ignore warnings from the FDA with regards to highlighting the dangers of its drug, and apparently making derogatory remarks about the FDA when the agency asked the company to look at the issue of labelling and adequate warnings on the packaging of the medication.
Merck now faces many lawsuits from those injured through taking Vioxx as well as from those that have lost a loved on because of the drug.
