The manufacturer of the controversial painkiller Vioxx was delivered bad news earlier this week with regards to litigation concerning its withdrawn painkiller. Merck was ordered to pay over $50 million to a heart attack victim by a federal jury. And in addition to this a New Jersey state judge overturned a ruling that had been made in November in the companys favor.
The trail in which the company had to make a payout was held in New Orleans, and the jury found that the doctors of retired FBI agent Gerald Barnett had not been given adequate or accurate information about the painkiller that was then prescribed to the man.
The state judge in New Jersey stated that following the November trial evidence had since come to light that showed that the manufacturer of the drug had not disclosed information that showed that taking the drug for under eighteen months could still increase the risk of heart attacks.
With regards to the New Orleans verdict, a Merck official stated: "Both the finding and the amount of damages were totally uncalled for in this case because Merck acted appropriately in providing information to the medical, scientific and regulatory communities in a responsible and appropriate manner."
