Pharmaceutical giant Merck has clocked up another victory in its fight against litigation over its controversial painkiller, Vioxx, which was withdrawn from the market in 2004 after it was found to increase the risk of heart attacks and strokes dramatically.
After several hours of deliberations, a state court jury in Los Angeles found that Merck was not responsible for the heart attack of seventy-one year-old Stewart Grossberg, who had been taking Vioxx before he suffered the heart attack.
Merck was found not guilty of negligence and not guilty of concealing information. Grossberg had been seeking over $200,000 in medical bills alone, as well as compensation and punitive damages on top of this.
Merck has always sworn to fight each case against it on an individual basis, and has so far won the majority of cases that have gone to trial. A spokesperson for Merck stated: Merck is pleased with the jury verdict. Todays outcome demonstrates, again, why we will defend these cases on a case-by-case basis.
