The Supreme Court in New Jersey has agreed to hear an appeal from the pharmaceutical giant Merck in relation to class action litigation over its controversial painkiller Vioxx, which was withdrawn from the market in 2004 after it was found to increase the risk of heart attacks and strokes in many patients.
The appeal is over a lower court decision that allowed health plans that paid for prescriptions of Vioxx to press ahead as a class action in order to recover what could amount to billions of dollars. The lower court ruling was made in March by three New Jersey Appellate Division judges.
Mercks outside counsel Ted Mayer said in a statement: "We have long believed that it is not an appropriate case to be handled as a class action because the situation of each insurance company and HMO is so different from one another. Every member of the supposed class had different types of information in deciding whether to reimburse patients for Vioxx."
Merck is currently at the center of thousands of lawsuits over its painkiller, Vioxx, but has always sworn that it will fight each one individually. So far it has won the majority of cases that have gone to court.
