The Food and Drugs Administration whistleblower, David Graham, will be deposed, with the judge stating that his testimony could help resolve many cases against drug manufacturing giant Merck over its controversial painkiller, Vioxx. Graham hit the limelight after criticizing the FDA for its handling of Vioxx.
A US government motion to quash plaintiffs lawyers subpoena of Graham was refused by a federal judge. Graham testified in 2004 at a congressional hearing, stating that the drug may have been responsible for up to 160 strokes and heart attacks.
In a statement Graham said that he would be happy to testify because he could help the public interest and was keen for the truth to come out. He said: "Who it hurts, who it helps is not my concern. I just want to make the truth clear."
A former FDA lawyer stated that the agency would not be eager for Graham to testify because, he stated, Grahams "opinions are in direct conflict with the agency in which he works."
