Merck, the pharmaceutical giant that manufactures the controversial cox-2 inhibitor Vioxx, has claimed another victory in court after the jury sided with the company in the case of Richard Irvin, a 53-year-old Florida man who died after being put on Vioxx for pain management. Irvin suffered a heart attack after using the drug for a short period and Merck claimed that the attack could not have been caused by Vioxx because the side effects did not occur in those that had taken the drug on a short term basis.
Merck officials further claimed that Irvins lifestyle was the major factor in his heart attack and that his age, gender, and diet all played a part. Irvins case was heard once before last year but jurors were unable to reach a verdict then due to damage caused by Hurricane Katrina.
The family of the deceased man claimed that his health had been extremely good until he started taking Vioxx. The widow of Mr. Irvin was very disappointed with the outcome, and her lawyer stated that he plans to discuss an appeal. He stated: "Obviously the family is very upset."
A lawyer for Merck stated that the verdict showed that the jury thought "that the Merck scientists lived up to their legal and ethical responsibilities when manufacturing and marketing Vioxx and making the decision to take Vioxx off the market."
