In May 2005 one of the leading makers of defibrillators began recalling certain models claiming they were defective in some way. This caused a great deal of stress and turmoil for a large number of people in the United States and Canada. So much so, that now some Canadians have begun to launch defibrillator class action suits against this company. A Toronto law firm has now taken control of the situation and has agreed to serve as council for those people who have been negatively impacted by these recently discovered defects.

At the time there was just one model of defibrillator being recalled but since then it has been discovered that other models may have certain kinds of defects as well or may be faulty in some way. This is why this Toronto based firm is launching a class action suit that covers all makes and models that are suspected of having some kind of defect or fault. People may wonder why the company is being sued for selling these devices. They say that they began recalling them as soon as they discovered that they were defective. However, there are certain law firms who believe that this isn’t exactly true. It has been found through extensive investigations that the United States based company continued to make and sell the defective models even after they discovered that they were faulty. This means that they showed clear neglect for their customer and therefore placed these people in grave danger. Also, at that point in time, they failed to notify their customers of the fact that defects have been identified. They continued to sell their products with no hesitation.

Of course there are always two sides to every story and the company being blamed for negligence is fighting back. In June 2005 after discovering that seven of their models of defibrillators were defective, they are currently being recalled. This means that over 50,000 people around the world who had purchased this device were at risk. The statement of recall was issued by this company after it was reported that seven of their models have failed to work over forty-five times and caused two deaths as a result. The company also went on to issue a safety warning regarding their products stating that as soon as the defects were identified they began recalling the products and people who have purchased a defibrillator should contact the company as soon as possible. They also advised doctors of the problems and asked doctors to watch their patients carefully. This means that as of June 17, 2005 there were approximately 47,000 defibrillators that were placed under warning.
In the year 2005, it was reported that almost 1,000 Canadians were using products being produced by this US company. Health Canada released a newsletter that stated that they had never received any such warning statement from the company stating the many defects and faults. The makers of these defibrillators stand by their product and state that there are no problems with the original model so anyone who has the original product has nothing to fear and this is why they continued to sell these products. In the last month, there have been other law firms who have launched class action suits against this company as well. These other law firms are from the United States and they are stating the same as the Canadian law firm; the makers of these defibrillators showed clear negligence when they continued to sell these products. It is felt by many people that they should have started taking their products off the market a long time ago, and waited until they identified the cause of the defects and fixed all products.
